How Is Compensation Calculated?

The first thing you need to know is how your injuries will impact your life.

How long will you be out of work? Will your injuries impact your ability to earn a living? Will you need ongoing physical therapy? If you don’t know this, there is no way to know if the amount offered by the insurance company is fair.

The second thing you need to know is how much you contributed to the accident.

In Maine, you cannot recover any compensation if you were more than 50 percent to blame for the accident — even if you were seriously injured. If you were less than 50 percent to blame, you can pursue compensation. But, that compensation will be reduced by the percentage of fault assigned to you. For example, if your lost wages and medical expenses amount to $100,000, and you were 20 percent at fault, you are entitled to $80,000.
