What Types Of Compensation Are Available?

If you've been injured in an accident, you may know you are entitled to compensation, but you may not know what type of compensation is available, or how it is calculated.

In Maine, you can recover compensation for the following:

  • Lost wages
  • Reduced future earning capacity
  • Current and future medical benefits
  • Pain and suffering

In certain cases, punitive damages may be available. Punitive damages serve a different purpose. Instead of reimbursing accident victims for their loss, they are meant to punish the person who caused the accident, discouraging future negligent or wrongful behavior.

At Cloutier, Conley & Duffett PA, our attorneys will sit down with you, review the circumstances surrounding your accident, and provide you with a realistic and reliable evaluation of your case.

How Is Compensation Calculated?

No one can give you an accurate estimate of what your case is worth until they have analyzed your injuries and the circumstances surrounding the accident.

The first thing you need to know is how your injuries will impact your life.

How long will you be out of work? Will your injuries impact your ability to earn a living? Will you need ongoing physical therapy? If you don't know this, there is no way to know if the amount offered by the insurance company is fair.

Our lawyers work closely with your treating physician to make sure the full extent of your injuries is known. Once we know how your injury will impact you in the long term, we work to maximize your claim.

The second thing you need to know is how much you contributed to the accident.

In Maine, you cannot recover any compensation if you were more than 50 percent to blame for the accident — even if you were seriously injured. If you were less than 50 percent to blame, you can pursue compensation. But, that compensation will be reduced by the percentage of fault assigned to you. For example, if your lost wages and medical expenses amount to $100,000, and you were 20 percent at fault, you are entitled to $80,000.
